Terms without the legal fog.

1. The parties

These Terms of Service ("Terms") form a legally binding agreement between you ("User", "you") and FGX Studios (Pty) Ltd, a company registered in South Africa and the provider of FCK Expensive AI ("we", "us", "FCK Expensive AI"). By creating an account or using the Service, you agree to these Terms in full.

2. Eligibility

You must be at least 18 years old to use the Service. By registering, you represent and warrant that you are 18 or older and that you have the legal capacity to enter into a binding contract. If you are accessing the Service on behalf of a business or legal entity, you represent that you have the authority to bind that entity to these Terms.

Users in sanctioned countries or those prohibited by applicable law from using AI generation services may not use the Service.

3. Account registration and security

You must provide a valid email address and create a secure password to register. You are responsible for keeping your credentials confidential. You are responsible for all activity that occurs under your account.

You agree to notify us immediately at support@fckexpensive.ai if you suspect any unauthorised use of your account. We will not be liable for any loss or damage arising from your failure to protect your credentials.

Accounts are personal and non-transferable unless otherwise agreed in writing. You may not sell, transfer, or sublicense your account.

4. The Service

FCK Expensive AI provides an AI-powered media generation platform enabling users to generate images, videos, and audio files using third-party AI models. The specific models available, their capabilities, and their credit costs are listed on the Models page and are subject to change with notice.

We make reasonable efforts to maintain uptime but do not guarantee uninterrupted access. Planned maintenance will be communicated in advance where possible. Unplanned outages will be resolved as quickly as practicable.

5. Credits

5.1 Free monthly credits

Every registered user receives 50 free credits at the start of each calendar month. These credits expire at the end of the month and do not roll over to the next month. Free credits are used before any other credit type.

5.2 Purchased credit packs

Credit packs (Starter, Creator, Studio, Pro) are one-time purchases. Credits purchased in a pack never expire and remain in your account until used. Purchased credits are used after free monthly credits are exhausted and before subscription credits, unless the subscription is active (see 5.3).

Credit pack prices are those displayed at the time of purchase. We reserve the right to change prices with 30 days notice. Purchases made before a price change are not affected.

5.3 Studio Monthly subscription

Studio Monthly is a monthly subscription priced at $19.99 per month. On subscription commencement and on each monthly renewal date, 3,000 credits are added to your account. These subscription credits expire on the next renewal date and do not roll over. Unused subscription credits are forfeited at renewal.

Subscription credits are used after free monthly credits. Purchased pack credits are used last.

The drain order is: (1) Free monthly credits, (2) Subscription credits, (3) Purchased credits.

5.4 Credit costs

The credit cost of each generation is displayed before you confirm a generation. Costs may vary by model, resolution, duration, and output count. By clicking "Generate", you consent to the deduction of the stated credit cost.

Credits are deducted at the time of generation submission. If a generation fails due to a system error on our side, we will refund the credits to your account. Credits are not refunded for failed generations caused by invalid prompts, content policy violations, or third-party API issues outside our control.

6. Billing and payments

6.1 Payment processor

All payments are processed by PayPal. By making a payment, you agree to PayPal's terms of service and privacy policy. We do not store your payment card details.

6.2 Subscription billing

By subscribing to Studio Monthly, you authorise recurring monthly charges to your PayPal account. Your subscription will renew automatically on the same date each month unless cancelled. You can cancel at any time through your account settings. Cancellation takes effect at the end of the current billing period.

6.3 Refunds

We offer refunds on the following basis:

• Credit packs: Unused credit packs may be refunded within 14 days of purchase if fewer than 10% of the credits have been used. Contact billing@fckexpensive.ai.
• Subscriptions: The current month's subscription fee is non-refundable after credits have been allocated. If you cancel within 24 hours of a renewal and have not used the newly allocated credits, we will review a refund request on a case-by-case basis.
• EU and UK consumer rights: If you are a consumer in the EU or UK, you have a statutory right to cancel a digital service contract within 14 days of purchase. However, by using the credits (by generating content), you explicitly waive this right with respect to those credits. Unused credits remain refundable within the 14-day window.

Refund requests must be made to billing@fckexpensive.ai. We aim to process valid refund requests within 5 business days.

6.4 Taxes

All prices are shown exclusive of applicable taxes. Users in the EU and UK may be subject to VAT. US users may be subject to applicable state sales tax. You are responsible for any taxes applicable to your use of the Service in your jurisdiction. Business customers in the EU may apply VAT reverse charge.

7. Acceptable use

You may use the Service to generate content for lawful personal and commercial purposes subject to the restrictions below. You agree not to:

• Generate content that is illegal in your jurisdiction or the jurisdiction in which it will be used
• Generate child sexual abuse material (CSAM) or any sexualised depiction of minors - this will result in immediate account termination and referral to law enforcement
• Generate content designed to defame, harass, or threaten a real, identifiable person
• Generate deepfakes of real individuals without their consent for deceptive purposes
• Generate content designed to incite violence or terrorism
• Attempt to circumvent content moderation filters
• Use the Service to train competing AI models without prior written consent
• Resell or sublicense access to the Service or the API
• Use automated tools to abuse the generation pipeline, spam the system, or harvest credits improperly
• Impersonate any person, business, or entity in a misleading way

We reserve the right to remove content and suspend or terminate accounts that violate these restrictions without notice or refund.

8. Intellectual property

8.1 Platform

The FCK Expensive AI platform, its design, brand assets, code, and documentation are owned by FGX Studios (Pty) Ltd or its licensors. Nothing in these Terms grants you any rights to our intellectual property beyond the limited licence to use the Service.

8.2 Your generated outputs

Subject to compliance with these Terms, we grant you a worldwide, perpetual, non-exclusive right to use, reproduce, modify, publish, and commercialise the images, videos, and audio you generate through the Service.

You acknowledge that AI-generated outputs may be similar or identical to outputs generated for other users, as AI models produce results based on patterns in training data. We make no guarantee of uniqueness.

8.3 Your input content

You retain all rights to text prompts and any files you upload (such as reference images or audio for isolation). By submitting them, you grant us a limited, non-exclusive licence to process them solely for the purpose of generating your requested output. We do not use your prompts or uploads to train our own models.

8.4 Third-party model terms

Outputs generated using specific AI models may be subject to the terms of those model providers (e.g. OpenAI, Runway, Google DeepMind, Stability AI). You are responsible for reviewing and complying with any usage restrictions imposed by those providers. Links to relevant terms are provided in the model documentation.

9. Privacy

Our collection and use of your personal data is governed by our Privacy Policy, which is incorporated into these Terms by reference.

10. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to merchantability, fitness for a particular purpose, and non-infringement.

AI-generated content may be inaccurate, offensive, or unsuitable for your intended use. You are responsible for reviewing all outputs before using or publishing them. We do not guarantee that outputs are legally usable in any particular jurisdiction or for any particular purpose.

We do not guarantee that the Service will be available at any specific time, that generations will complete without error, or that the quality of any particular generation will meet your expectations.

11. Limitation of liability

To the fullest extent permitted by applicable law, FGX Studios (Pty) Ltd and its directors, employees, agents, and licensors will not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, including loss of revenue, loss of data, or business interruption, even if advised of the possibility of such damages.

Our total liability to you for any claim arising from or related to the Service is limited to the greater of (a) the amount you paid us in the 3 months preceding the claim, or (b) $50 USD.

Consumer rights (EU/UK): Nothing in these Terms limits or excludes liability for death or personal injury caused by our negligence, fraudulent misrepresentation, or any liability that cannot be excluded by law. UK and EU consumers retain all mandatory statutory rights.

12. Indemnification

You agree to indemnify and hold harmless FGX Studios (Pty) Ltd, its directors, employees, agents, and licensors from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising from your use of the Service, your violation of these Terms, or your violation of any third-party rights.

13. Termination

You may delete your account at any time through your account settings. This will cancel any active subscription at the end of the current billing period and permanently delete your stored generated files.

We may suspend or terminate your account immediately for material breach of these Terms, abuse of the platform, fraudulent activity, or legal reasons. In such cases, we will provide notice where legally required. Termination for material breach does not entitle you to a refund of unused credits.

On termination, all provisions that by their nature should survive will survive, including Intellectual Property, Limitation of Liability, and Indemnification.

14. Changes to the Service and Terms

We reserve the right to modify the Service, change credit costs, add or remove models, and update these Terms. For material changes, we will provide at least 30 days notice via email. Your continued use of the Service after the effective date of changes constitutes acceptance of the new Terms.

If you do not agree with a material change, you may close your account before the effective date and receive a refund of any unused purchased credits.

15. Governing law and dispute resolution

These Terms are governed by the laws of the Republic of South Africa. If a dispute cannot be resolved informally (see below), it shall be subject to the non-exclusive jurisdiction of the courts of South Africa.

EU consumers: If you are a consumer resident in the EU, you also have the right to bring proceedings in the courts of the EU member state where you are domiciled, and to use the EU Online Dispute Resolution platform at ec.europa.eu/consumers/odr.

UK consumers: UK consumers may use alternative dispute resolution through approved schemes. Contact legal@fckexpensive.ai for details.

15.1 Informal resolution

Before raising a formal dispute, you agree to first contact us at legal@fckexpensive.ai and give us 30 days to attempt to resolve the issue informally. Most disputes are resolved at this stage.

16. Miscellaneous

• Entire agreement: These Terms, along with our Privacy Policy and Credit Rules, constitute the entire agreement between you and us with respect to the Service.
• Severability: If any provision of these Terms is found unenforceable, the remaining provisions will continue in full force.
• No waiver: Our failure to enforce any provision does not constitute a waiver of our right to do so in the future.
• Assignment: You may not assign your rights under these Terms without our prior written consent. We may assign ours in connection with a merger, acquisition, or sale of assets.
• Language: The English-language version of these Terms is the governing version. Translations, if provided, are for convenience only.
